Democrats Weaponize Government Agencies Against Musk

Our honored guest writer  is Alexandra Merz, also known as TeslaBoomerMama.on X. She has has a world wide reputation in economics and disruptive technology. She also recently became a United States citizen. Welcome!

It is disturbing that Biden has weaponized the U.S. government against Elon Musk. Examples: Federal Communication Commission, National Highway Traffic and Safety Administration, Fish and Wildlife Service, Department of Justice, Security and Exchange Commission, Federal Aviation Administration, Environmental Protection Administration. For documentation see this article by Alexandra and those references listed after her fine article.

Musk is imperfect and has by his own admissions made many mistakes. Nonetheless he has done more to fight climate change than any other government, organization, or individual. He has also greatly advanced space goals, saved the United States millions of dollars with SpaceX, and advanced the goals of both humanity and free speech with each of his companies. I am not surprised fossil fuel companies have successfully targeted those on the right to hate him with lies. I am disappointed those on the left also believe this nonsense while giving Biden/Harris a pass.

Coordinated Political Pressure and Legal Actions Against Tesla Since Elon's Twitter Acquisition   by Alexandra Merz, also known as TeslaBoomerMama.on X.

The acquisition of Twitter by Elon on October 28, 2022, has clearly intensified political and legal pressure on Tesla, SpaceX, and Elon himself. This article examines the series of actions taken by various government bodies and political figures which I view as coordinated efforts against Elon Musk's companies and us, Tesla shareholders.

Background

Prior to the Twitter acquisition, there were already signs of tension between the Biden-Harris administration and Tesla, notably when Tesla was not invited to the August 2021 EV summit at the White House.

The pressure has escalated significantly following Elon's purchase of Twitter; with President Biden's call for federal investigation of Elon Musk over ‘relationships with other countries’ in November 2022, just one month after the Twitter purchase.

Legal and Regulatory Actions

Several federal agencies have initiated investigations or legal actions against Tesla and other Musk-led companies since late 2022:

  1. Department of Justice (DOJ): Investigating Tesla (Reuter's article dated October 2022)
  2. Equal Employment Opportunity Commission (EEOC): Sued Tesla (September 2023)
  3. DOJ: Sued SpaceX for alleged discriminatory hiring practices, not hiring refugees (August 2023)
  4. Federal Trade Commission (FTC): Demanded internal Twitter documents from Musk (December 2022) (if you have not read it yet, please read the US House of Rep's Subcommittee hearing on the matter,

here

)

  1. Securities and Exchange Commission (SEC): Investigating Musk's Twitter purchase (October 2023)

Pressure from Senators Blumenthal and Markey

Senators Richard Blumenthal (D-CT) and Edward Markey (D-MA) have been particularly active in calling for investigations and recalls of Tesla vehicles. They have issued joint statements or letters on seven occasions in

Senator Elizabeth Warren's Actions

Senator Elizabeth Warren (D-MA) has taken the most significant steps:

  • December 18, 2022: She sent a letter to Tesla's Board Chair, Dr. Robyn Denholm (

here

), expressing concerns about potential conflicts of interest and misuse of Tesla resources following Musk's Twitter acquisition. This letter was actually written by Senator Blumenthal, as the properties of the document clearly show (see image below), then it was "repackaged" as a letter from Senator Warren. In this letter, the sources cited are mainly outraged media articles, the list of journalists is in the notes below.

  • June 17, 2023: Senator Warren wrote to SEC Chair Gary Gensler, requesting an investigation into Tesla (

here

)

  • March 21, 2024: She then sent a follow-up letter to the SEC, citing for the first time the Delaware Chancery Court post-Trial opinion for the Tornetta case regarding Elon Musk's compensation plan (

here

).

  • August 8, 2024: In Senator Warren's letter from last week (

here

), she sustained her claims with more than just journalists' articles. She explicitly uses several times the post-Trial opinion of Chancelor McCormick in the Tornetta case, and uses even more often a new shareholder complaint filed in Delaware the day of the shareholder vote, June 13, 2024:

Recent Legal Developments

On June 13, 2024, i.e. the day before Tesla incorporated in Texas, new lawsuits were filed in the Delaware Chancery Court by pension funds and individual shareholders against Elon Musk and Tesla's board members. The one mentioned by Senator Warren can be accessed

here

Conclusion

The timeline of events clearly shows a marked increase in regulatory scrutiny and political pressure on Tesla, its Board members and of course Elon, following the Twitter acquisition. While some view these actions as necessary oversight, I argue that they represent a coordinated effort to target Elon Musk and his companies. As shareholders we must speak up, and if you are inclined to do so, please sign the shareholder letter to Senator Warren that will be accessible, until Tuesday, August 13, 2024 (link
